By visiting our website or making a purchase, you use our services and agree to be bound by these Terms & Conditions, including any additional terms and policies referred to through links on our website. These terms apply to all users of the website, including visitors, customers, suppliers, and other users of our services or products.
By using this website, you confirm that you have read, understood, and accepted these terms. If you do not agree with these terms, you should not use our website or services.
1. Applicability
1.1 These terms apply to all offers, orders, deliveries, and agreements concluded through the Nostalgic Lab webshop or other digital sales channels.
1.2 Any deviation from these terms is only valid if agreed upon in writing.
1.3 If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
2. Offers and Agreements
2.1 Our offers contain a clear description of the products being offered. Obvious errors, inaccuracies, or mistakes in an offer do not bind Nostalgic Lab.
2.2 An agreement is concluded once the customer has placed an order and the payment has been successfully completed.
3. Prices and VAT
3.1 Nostalgic Lab applies VAT reverse charge treatment to purchases where legally applicable. Where this mechanism applies, VAT is not charged on the invoice.
3.2 The buyer is responsible for any VAT obligations that legally apply to the transaction.
3.3 Prices displayed on the website are the final prices payable by the customer, unless explicitly stated otherwise.
3.4 Nothing in these Terms & Conditions limits or excludes any tax obligations imposed by applicable law.
4. Cancellation Within 24 Hours
4.1 Customers may request cancellation of an order within 24 hours of placing it by emailing support@nostalgiclab.com and including the order number.
4.2 If an order has already been shipped or transferred to the carrier, cancellation may no longer be possible.
4.3 The 24 hour cancellation option is separate from any statutory right of withdrawal that may apply after receiving the order.
5. Processing and Delivery
5.1 Orders are generally processed within a maximum of two business days.
5.2 The estimated delivery time is three to seven business days within the Netherlands and Belgium, and seven to ten business days for other destinations.
5.3 Delays may occur due to customs inspections, carrier delays, high shipping volumes, or other circumstances beyond our reasonable control.
5.4 Track & Trace information becomes available once the shipment has been processed or scanned by the carrier.
5.5 Responsibility for loss or damage during delivery is determined in accordance with applicable consumer law and cannot be transferred to the customer where the law provides otherwise.
6. Right of Withdrawal
6.1 Where the statutory right of withdrawal applies, consumers may withdraw from the purchase within 14 days after receiving the goods, without having to provide a reason.
6.2 To exercise this right, the customer must clearly inform Nostalgic Lab of the decision to withdraw. This can be done by emailing support@nostalgiclab.com.
6.3 Unless otherwise required by applicable law, the direct cost of returning the goods is borne by the customer. Customers are advised to use a shipping method with Track & Trace and retain proof of shipment.
6.4 Refunds will be processed in accordance with the applicable statutory refund period and using the original payment method, unless otherwise agreed.
6.5 The customer may inspect and handle the product only to the extent necessary to establish its nature, characteristics, and functioning. The customer may be liable for any reduction in value resulting from handling beyond what is necessary for this assessment.
7. Returns and Exchanges
7.1 Returned products should include all reasonably necessary components and accessories originally supplied with the product.
7.2 We recommend using suitable protective packaging when returning a product to prevent damage during transport. The original packaging is recommended where available, but is not mandatory unless legally permitted in the specific circumstances.
7.3 Customers are advised to retain their shipping receipt and Track & Trace information until the return has been received and processed.
8. Warranty and Conformity
8.1 Products must comply with the agreement and with the statutory conformity requirements applicable to the purchase.
8.2 Normal wear and tear, cosmetic imperfections that were disclosed before purchase, or characteristics that can reasonably be expected from the age and condition of retro or refurbished electronics do not automatically constitute a defect.
8.3 Damage resulting from improper use, unauthorized modifications, liquid damage, or incorrect installation may fall outside warranty coverage where permitted by applicable law.
8.4 Nothing in these terms limits the customer's mandatory statutory rights regarding defective or non conforming products.
9. Liability
9.1 To the extent permitted by applicable law, Nostalgic Lab is not liable for indirect or consequential losses that are not reasonably attributable to Nostalgic Lab.
9.2 Any limitation of liability applies only insofar as permitted by applicable law.
9.3 Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability arising from intentional misconduct or gross negligence.
10. Force Majeure
10.1 If Nostalgic Lab is prevented from fulfilling its obligations due to circumstances beyond its reasonable control, performance may be suspended for the duration of those circumstances, subject to the customer's mandatory statutory rights.
11. Privacy and Cookies
11.1 Personal data is processed in accordance with our Privacy Policy and applicable data protection legislation.
11.2 Information about cookies and available choices regarding non essential cookies is provided through our Cookie Policy and cookie settings.
